1. Annahme der Bedingungen

Diese Nutzungsbedingungen ("Bedingungen") stellen eine rechtlich bindende Vereinbarung zwischen Ihnen ("Benutzer", "Sie" oder "Ihr") und WorkTime One ("WorkTime One", "wir", "uns" oder "unser") dar, die Ihren Zugriff auf und die Nutzung der WorkTime One-Plattform regelt, einschließlich unserer Website, mobilen Anwendungen und zugehörigen Dienste (zusammen der "Dienst").

Durch das Erstellen eines Kontos, den Zugriff auf oder die Nutzung unseres Dienstes bestätigen Sie, dass Sie diese Bedingungen und unsere Datenschutzrichtlinie gelesen, verstanden und akzeptiert haben. Wenn Sie mit diesen Bedingungen nicht einverstanden sind, dürfen Sie den Dienst nicht nutzen.

Wichtig Diese Bedingungen enthalten eine Schiedsklausel und einen Verzicht auf Sammelklagen, die Ihre Rechte beeinträchtigen. Bitte lesen Sie Abschnitt 14 sorgfältig durch.

2. Beschreibung des Dienstes

WorkTime One ist eine cloudbasierte Plattform zur Zeiterfassung und Anwesenheitsverwaltung von Mitarbeitern, die sich in TTLock-Smartlocks integriert und Folgendes bietet:

  • Automatische Mitarbeiterzeiterfassung durch Smartlock-Zugriff
  • Anwesenheitsüberwachung und Berichterstattung
  • Gehaltsabrechnung einschließlich Überstunden, Strafen und Boni
  • Mitarbeiterverwaltungs- und Organisationsstrukturwerkzeuge
  • Integration mit RFID/NFC-Karten, Fingerabdrucklesern und PIN-Codes
  • Berichts- und Analyse-Dashboards
  • E-Mail-Benachrichtigungen und Warnungen
  • Unterstützung für mandantenfähige Organisationen

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with or without notice.

3. Berechtigung

Um WorkTime One zu nutzen, müssen Sie:

  • Mindestens 18 Jahre alt sein
  • Die rechtliche Fähigkeit haben, bindende Verträge abzuschließen
  • Nicht daran gehindert sein, den Dienst gemäß geltendem Recht zu nutzen
  • Befugt sein, die Organisation zu vertreten und zu binden, in deren Namen Sie sich registrieren
  • Genaue, aktuelle und vollständige Informationen bei der Registrierung angeben

By using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Kontoregistrierung und Sicherheit

4.1 Kontoerstellung

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, complete, and up-to-date registration information
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities under your account

4.2 Kontosicherheit

You are responsible for maintaining the security of your account credentials. We strongly recommend:

  • Using a strong, unique password
  • Enabling two-factor authentication (2FA)
  • Never sharing your login credentials
  • Logging out after each session, especially on shared devices

4.3 Kontobeendigung

We reserve the right to suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is inactive for more than 12 months
  • We detect fraudulent, abusive, or illegal activity
  • Payment obligations are not met
  • Required by law or legal authority

5. Abonnement und Zahlung

5.1 Kostenlose Stufe

WorkTime One offers a free tier for organizations with up to 3 active employees. Free tier accounts have access to all features but are subject to fair use policies.

5.2 Bezahlte Abonnements

Organizations with 4 or more employees must subscribe to a paid plan. Pricing is based on:

  • Number of active employees (progressive pricing tiers)
  • Billing frequency (monthly or yearly)
  • Additional features or integrations (if applicable)

5.3 Abrechnung und Zahlungsbedingungen

  • Billing Cycle: Monthly or annual billing based on your selected plan
  • Payment Methods: Credit card, debit card, or other approved payment methods
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Price Changes: We may change prices with 30 days' notice. Changes apply to subsequent billing cycles
  • Taxes: Prices exclude applicable taxes, VAT, or duties, which you are responsible for
  • Failed Payments: If payment fails, we may suspend access until payment is received

5.4 Rückerstattungsrichtlinie

We offer a 14-day money-back guarantee for first-time subscribers. After 14 days, payments are non-refundable except:

  • Service unavailability exceeding our SLA commitments
  • Billing errors or duplicate charges
  • As required by applicable consumer protection laws

5.5 Kündigung

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

6. Richtlinie zur akzeptablen Nutzung

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service to track individuals without their knowledge or consent
  • Upload viruses, malware, or malicious code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Interfere with or disrupt the Service's integrity or performance
  • Resell, sublicense, or redistribute the Service without authorization
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use the Service for competitive analysis or to build competing products

6.2 Mitarbeiterdatenschutz-Compliance

You are responsible for:

  • Obtaining necessary consents from employees for time tracking and biometric data collection
  • Complying with applicable labor laws and privacy regulations
  • Informing employees about data collection, use, and retention
  • Implementing fair and transparent employee monitoring policies
  • Respecting employee privacy rights and data protection laws

6.3 Datengenauigkeit

You are responsible for the accuracy, quality, and legality of data you input into the Service. We are not liable for decisions made based on inaccurate or incomplete data.

7. Datenbesitz und Lizenz

7.1 Ihre Daten

You retain all ownership rights to data you input into the Service ("Customer Data"). We claim no ownership over Customer Data.

7.2 Lizenz zur Nutzung Ihrer Daten

You grant us a limited, non-exclusive, royalty-free license to use, store, process, and transmit Customer Data solely to:

  • Provide and maintain the Service
  • Generate reports and analytics for your use
  • Improve service quality and develop new features
  • Comply with legal obligations
  • Create anonymized, aggregated data for statistical purposes

7.3 Datenübertragbarkeit

You may export your data at any time in standard formats (CSV, Excel, JSON). Upon account termination, you have 30 days to export your data before permanent deletion.

7.4 Anonymisierte Daten

We may use anonymized, aggregated data derived from Customer Data for industry research, benchmarking, and product improvement. This data cannot be used to identify you or your employees.

8. Geistiges Eigentum

8.1 Unsere Rechte

The Service and all related materials, including software, design, text, graphics, logos, and trademarks, are owned by WorkTime One or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Beschränkte Lizenz

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.

8.3 Einschränkungen

You may not copy, modify, distribute, sell, or lease any part of the Service or its software. You may not reverse engineer or attempt to extract source code unless laws prohibit these restrictions.

8.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to compensate you. You grant us a perpetual, worldwide, royalty-free license to use such feedback.

9.1 Service-Verfügbarkeit

We strive for 99.9% uptime but cannot guarantee uninterrupted or error-free service. Scheduled maintenance and unforeseen issues may cause temporary service disruptions.

9.2 Haftungsausschluss

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

9.3 Drittanbieter-Integrationen

Our integration with TTLock and other third-party services is dependent on their APIs and availability. We are not responsible for third-party service failures, changes, or discontinuations.

9.4 Keine Rechts- oder Compliance-Beratung

WorkTime One is a technology tool. We do not provide legal, accounting, or compliance advice. You are responsible for ensuring your use of the Service complies with applicable laws and regulations.

10. Haftungsbeschränkung

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKTIME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Service interruptions or data loss
  • Unauthorized access to or alteration of your data
  • Errors or inaccuracies in the Service
  • Actions of third parties (including TTLock)
  • Labor disputes, employment claims, or payroll errors arising from Service use

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

11. Entschädigung

You agree to indemnify, defend, and hold harmless WorkTime One, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service
  • Violation of these Terms or applicable laws
  • Violation of third-party rights, including employee privacy rights
  • Your Customer Data, including inaccuracies or illegal content
  • Employment disputes or labor law violations arising from Service use
  • Unauthorized access to your account due to your negligence

12. Kündigung

12.1 Kündigung durch Sie

You may terminate your account at any time by cancelling your subscription through account settings or contacting support. Termination takes effect at the end of the current billing period.

12.2 Kündigung durch WorkTime One

We may suspend or terminate your account immediately if:

  • You breach these Terms or our Acceptable Use Policy
  • Payment obligations are not met within 30 days of notice
  • We detect fraudulent, abusive, or illegal activity
  • Your account is inactive for over 12 months
  • Required by law or legal authority
  • We discontinue the Service (with 90 days' notice)

12.3 Auswirkungen der Beendigung

Upon termination:

  • Your access to the Service will be immediately revoked
  • You have 30 days to export your data
  • After 30 days, we will permanently delete your data (except as required by law)
  • No refunds will be provided for unused subscription time
  • Sections 7-15 of these Terms will survive termination

We may modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice for material changes affecting functionality.

We may update these Terms to reflect changes in our practices, legal requirements, or business operations. We will notify you by:

  • Posting updated Terms on our website with a new "Last Updated" date
  • Sending email notification to your registered email address
  • Displaying in-app notification for material changes

Material changes take effect 30 days after notification. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to changes, you must terminate your account.

14. Anwendbares Recht und Streitbeilegung

14.1 Anwendbares Recht

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Schiedsvereinbarung

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

The arbitration will be conducted in Delaware, or remotely via video conference. The arbitrator's decision is final and binding. Each party bears its own costs unless otherwise awarded by the arbitrator.

14.3 Verzicht auf Sammelklagen

IMPORTANT: CLASS ACTION WAIVER

YOU AND WORKTIME AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

14.4 Ausnahmen

Either party may seek injunctive relief in court to protect intellectual property rights or prevent unauthorized access to the Service.

14.5 Internationale Nutzer

If you are located outside the United States, you consent to having your data transferred to and processed in the United States. Local laws may provide additional rights not waived by these Terms.

15. Allgemeine Bestimmungen

15.1 Gesamtvereinbarung

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and WorkTime One regarding the Service.

15.3 Salvatorische Klausel

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

15.2 Verzicht

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

15.4 Abtretung

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.6 Höhere Gewalt

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet failures.

15.6 Exportkontrolle

You agree to comply with all applicable export and import laws. You represent that you are not located in a country subject to U.S. embargo or listed as a prohibited party.

15.7 Sprache

These Terms are provided in English. Translations may be provided for convenience, but the English version prevails in case of conflicts.
